Terms of Use

Welcome to ProfileLoom. These Terms of Use ("Terms") govern your access to and use of the ProfileLoom website, portrait-generation workflow, downloads, and related features (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy and Cookies Policy. If you do not agree, do not use the Service.

1. Overview

ProfileLoom helps users create profile-ready portraits from one uploaded photo. The Service lets you choose a portrait type, choose a platform or use case, upload a portrait or selfie, optionally provide style preferences where available, generate a portrait, preview the result, and download the output.

2. Eligibility And Account Use

You must be old enough to use online services and to consent to personal data processing under the laws that apply to you. You are responsible for keeping access to your login provider and email secure, and for all activity under your account. You must provide accurate account and billing information and promptly report suspected unauthorized use.

3. License To Use The Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful personal or commercial profile-picture purposes. We reserve all rights not expressly granted in these Terms.

4. Acceptable Use

You agree not to use the Service, directly or indirectly, to engage in unlawful, harmful, deceptive, abusive, or otherwise prohibited conduct. You must not upload, request, generate, or use content that:

• violates any law, regulation, third-party right, or these Terms;
• infringes intellectual property, privacy, publicity, confidentiality, or contractual rights;
• impersonates another person or misrepresents identity, affiliation, credentials, or endorsement;
• creates deceptive profile images, fake identity content, fraud, spam, scams, or misleading representations;
• harasses, threatens, bullies, exploits, sexualizes, or harms any person, including minors;
• contains non-consensual intimate imagery, illegal sexual content, or exploitative content;
• promotes violence, self-harm, discrimination, hatred, illegal products, or illegal services;
• contains malware, attempts to disrupt the Service, or tries to bypass security or safety systems;
• reverse engineers, copies, modifies, decompiles, or attempts to extract source code from the Service.

You are responsible for how you present and use AI-generated portraits. Do not mislead others into believing an AI-generated or edited image is an unaltered photo when that distinction matters.

5. User Content

"User Content" means photos, prompt preferences, text, metadata, or other materials you submit to the Service. You retain ownership of your User Content. You represent and warrant that you have all rights, licenses, permissions, and consents needed to upload and use your User Content with the Service.

By submitting User Content, you grant us and our service providers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, process, modify, and display User Content solely as needed to operate, secure, troubleshoot, improve, and provide the Service and its generated outputs.

6. Generated Content

"Output" means portraits or other content generated by the Service. Subject to your compliance with these Terms and applicable law, you may use, download, modify, publish, and share your Output for personal or commercial profile-picture purposes. No attribution to ProfileLoom is required unless a separate agreement says otherwise.

AI outputs may not be unique. Other users may receive similar or visually related outputs, especially when they choose similar portrait types, platforms, or prompts. You are responsible for reviewing each Output before using it in public profiles, resumes, business pages, creator channels, or other contexts.

7. Billing, Credits, And Paid Features

New accounts may receive a one-time welcome credit grant. Portrait generation consumes credits according to the selected output mode and number of images. Additional one-time credit packs may be purchased through the pricing page. Prices, taxes, included credits, and applicable limits are shown before checkout.

One-time credit packs do not automatically renew. Welcome credits and purchased credits may have different eligibility, expiration, transfer, or promotional rules when disclosed. Credits have no cash value, may not be transferred between accounts, and are deducted only after a successful generation is recorded.

8. Refund Policy

Digital AI generation services involve non-physical, server-side processing and third-party generation costs. Unless a different refund rule is shown at checkout or required by law, completed generations, used credits, and delivered digital outputs are non-refundable.

If a paid generation fails because of a technical issue attributable to the Service, we may, at our discretion, provide a retry, credit restoration, replacement generation, or refund where appropriate.

9. Intellectual Property

The Service, including software, code, design, interface, prompts, model routing, branding, logos, and site content, is owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, distribute, sell, lease, modify, or create derivative works from the Service except as allowed by these Terms.

If you provide feedback, suggestions, or ideas, you grant us a perpetual, worldwide, royalty-free, sublicensable license to use that feedback for any purpose without compensation to you.

10. Third-Party Services

The Service may rely on third-party providers for hosting, storage, AI model processing, payments, analytics, or other infrastructure. Your use of the Service may involve processing by those providers. We are not responsible for third-party services, websites, or policies that we do not control.

11. Disclaimer

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, secure, error-free, or that outputs will be accurate, unique, suitable for every platform, or accepted by any employer, website, social network, marketplace, or community.

AI-generated portraits may contain errors, artifacts, changed details, inaccurate likeness, or unexpected results. You use the Service and any Output at your own risk and are solely responsible for evaluating whether an Output is appropriate for your intended use.

12. Indemnification

You agree to defend, indemnify, and hold harmless ProfileLoom, its operators, service providers, affiliates, and personnel from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, your Output, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Limitation Of Liability

To the maximum extent permitted by law, ProfileLoom and its operators, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of or inability to use the Service.

To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to use the Service in the twelve months before the event giving rise to the claim, or USD $100 if you have not paid us.

14. Termination

These Terms begin when you first use the Service and continue until terminated. You may terminate them by stopping use of the Service. We may suspend, limit, or terminate access to the Service at any time if we believe you violated these Terms, created risk for the Service or other users, abused the system, or used the Service unlawfully.

Sections relating to User Content licenses, generated content, intellectual property, disclaimers, indemnification, limitation of liability, and other provisions that should reasonably survive will survive termination.

15. Changes To These Terms Or The Service

We may update these Terms from time to time by posting the revised version on the website and updating the "Last updated" date. We may also add, change, restrict, suspend, or discontinue parts of the Service at any time. Your continued use of the Service after updated Terms are posted means you accept the updated Terms.

16. Disputes

If a dispute arises, the parties should first try to resolve it informally and in good faith. If it cannot be resolved informally, the dispute will be handled in the courts or forum permitted by applicable law.
